An Abstract is a condensed history of the property and includes all of the recorded transactions affecting the property. The purpose of an abstract is to give the examiner the condition of title to the property as it appears of record. An abstract contains information such as: the current and prior owners of the property, mortgages against the property, satisfactions of prior mortgages, easements and rights-of-way across the property, bankruptcy matters and more.

The Title Team provides experienced closers who are knowledgeable about all real estate closings. An Owners and Encumbrance Report shows the record title owner and encumbrances to a specific tract of land. This report is not intended to be an attorney's opinion. Sometimes it is referred to as a title memorandum or report of title. Information included on a title search is unsatisfied mortgages, judgments and liens, and tax information.

Title Insurance is protection against loss of the insured interest in the property if a covered defect is found in the title. Title insurance is offered by all affiliated offices for North Dakota properties and plays a vital role in residential and commercial transactions.

A Construction Binder is to be ordered when a lender is providing interim construction financing, and North
Dakota Guaranty & Title Co. will issue a title commitment at that time. A search of the public records is
conducted; however, no title insurance premiums are charged, and no title insurance policy is issued. The
Construction Binder will reflect the lender providing the interim construction financing with the dollar amount
to be determined. The Construction Binder is valid for 6 months and may be extended upon request.

Construction to Permanent Financing should be used when North Dakota Guaranty & Title Co. will be asked to issue a lender’s title insurance policy to insure the permanent financing of the newly constructed improvements. A search of the public records is conducted, and a lender’s title insurance premium is charged. Upon closing and recording of the mortgage to be insured, a lender’s title insurance policy is issued. The Title Commitment will reflect the lender providing the financing along with the dollar amount of the mortgage(s); which will be the face value of the policy to be issued.
An owner’s title insurance policy may also be issued at a special simultaneous rate. The owner’s title insurance policy will insure the owner(s) of the subject property for the appraised value of the subject property.

The Limited Loan Coverage Policy (LLC Policy) is used for Home Equity loans. A Limited Liability Loan Title Insurance Policy will be issued. The mortgage for which the policy is insuring must be recorded before the Limited Loan Coverage Policy is issued.
The Limited Loan Coverage Policy is limited as to what is shown as unsatisfied mortgages, judgments and taxes of record.

The Title Team will provide U.C.C. ( Uniform Commercial Code) filings and searches, and will serve as a "registered agent" for out-of-state companies doing business in North Dakota. We file corporate documents, and check for and retrieve Certificates of Good Standing at the North Dakota Secretary of State's office and the North Dakota Insurance Department.
